Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand. 


This update is provided on a weekly basis.


LEGISLATION CHANGES

Commonwealth Inscribed Stock (Maximum Total Face Value of Stock and Securities) Amendment Direction 2020

  • Increases the maximum total face value of stock and securities from $850 billion to $1,200 billion, to provide certainty to financial markets about the Government’s ability to issue additional debt in response to the COVID‑19 pandemic.

Coronavirus Economic Response Package (Payments and Benefits) Alternative Decline in Turnover Test Amendment Rules 2020

  • Gives certain entities or classes of entities an alternative basis on which they may satisfy the actual decline in turnover test or the decline in turnover test to be eligible for JobKeeper payments.

Industry Research and Development (Exploring for the Future Program) Instrument 2020

  • Prescribes the Exploring for the Future Program.

Taxation Administration Act Withholding Schedules No.2 2020

  • Sets out the amounts, formulas and procedures to be used for calculating the amount required to be withheld by entities from withholding payments, and includes updates in response to the changes to tax scales that are contained in Treasury Laws Amendment (A Tax Plan for the COVID-19 Economic Recovery) Bill 2020.


Public Health (COVID-19 Interstate Hotspots) Emergency Direction Revocation 2020

  • Revokes the Public Health (COVID-19 Interstate Hotspots) Emergency Direction (No 5).

Public Health (COVID-19 Interstate Travellers) Emergency Direction 2020 (No 2)

  • Prohibited affected persons from entering the ACT except in certain circumstances, requires residents of the ACT to quarantine following travel from Victoria, and requires certain notification and supervision in relation to an unaccompanied child arriving in the ACT.

Public Health (Restricted Activities - Gatherings, Business or Undertakings) Emergency Direction 2020 (No 12)

  • Restricts non-essential gatherings and the operation of non-essential businesses and undertakings in order to limit the spread of COVID-19.

Public Health (Returned Travellers) Emergency Direction 2020 (No 8)

  • Restricts non-essential gatherings and the operation of non-essential businesses and undertakings in order to limit the spread of COVID-19.

Public Health (Self-Isolation) Emergency Direction 2020 (No 4)

  • Requires people who are diagnosed with COVID-19 and people identified as a close contact to self-isolate.



Directions in Relation to Persons Arriving in Tasmania (General)

  • Requires persons who arrive in Tasmania from outside the State to answer questions and provide information to authorised officers and to isolate for 14 days at an accommodation facility.


Area Directions (No 9)

  • Identifies areas within Victoria which have a higher prevalence of, or risk of exposure to, COVID-19 and which are subject to specific directions which are reasonably necessary to protect public health - came into force at 11:59 pm on 11 October 2020.

Care Facilities Directions (No 13)

  • Provides for restricted access to care facilities to limit the spread of COVID-19 within a particularly vulnerable population - came into force at 11:59 pm on 11 October 2020.

Diagnosed Persons and Close Contacts Directions (No 12)

  • Requires persons diagnosed with COVID-19 to self-isolate, and persons living or in close contact with a diagnosed person to self-quarantine - came into force at 11:59 pm on 11 October 2020.

Hospital Visitor Directions (No 13)

  • Prohibits non-essential visits to hospitals to limit the spread of COVID-19 - came into force at 11:59 pm on 11 October 2020.

Permitted Worker Permit Scheme Directions (No 7)

  • Establishes the Permitted Worker Permit Scheme - came into force at 11:59 pm on 11 October 2020.

Premier’s Declaration of a State of Disaster

  • Declares that a state of disaster exists in relation to the whole of Victoria until 11:59 pm on 8 November 2020.

Restricted Activity Directions (Non-Melbourne) (No 7)

  • Restricts the operation of certain businesses and undertakings in Victoria in the relevant area to address the serious public health risk posed by COVID-19 - came into force at 11.59 pm on 11 October 2020.

Restricted Activity Directions (Restricted Areas) (No 12)

  • Restricts the operation of certain businesses and undertakings in the restricted area - came into force at 11.59 pm on 11 October 2020.

Stay at Home Directions (Restricted Areas) (No 18)

  • Requires persons who ordinarily reside in the restricted area to limit their interactions with others by restricting circumstances in which they may leave the residence and the restricted area, restricting gatherings, and prohibiting private gatherings (except in limited circumstances) - came into force at 11.59 pm on 11 October 2020.

Stay Safe Directions (Non-Melbourne) (No 4)

  • Requires persons who ordinarily reside in the relevant area to  wear face coverings, and limit their interactions with others by restricting gatherings, and restricts the circumstances in which they may leave the relevant area  - came into force at 11.59 pm on 11 October 2020.

Workplace (Additional Industry Obligations) Directions (No 8)

  • Limits the number of Victorians attending certain work premises to assist in reducing the frequency and scale of COVID-19 outbreaks in workplaces, and establishes additional specific obligations on employers and workers in specific industries in relation to managing the risk associated with COVID-19 - came into force at 11.59 pm on 11 October 2020.

Workplace Directions (No 7)

  • Limits the number of Victorians attending work premises to assist in reducing the frequency and scale of COVID-19 outbreaks in workplaces, and establishes more specific obligations on employers and workers in relation to managing the risk associated with COVID-19 - came into force at 11:59 pm on 11 October 2020.


COVID-19 Public Health Response (Alert Level Requirements) Amendment Order (No 3) 2020

  • Amends the COVID-19 Public Health Response (Alert Level Requirements) Order 2020 so that the alert level 2 requirements set out in Part 3 of that order cease to apply to the Auckland area.

Designation of Higher-risk Routes - COVID-19 Public Health Response (Air Border) Order (No 2) 2020

  • Declares certain routes as higher-risk routes.

Immigration (Visa, Entry Permission, and Related Matters) Amendment (COVID-19 - Applications and Fees) Regulations (No 2) 2020

  • Amends the Immigration (Visa, Entry Permission, and Related Matters) Regulations 2010 to extend the suspension of certain visa applications, clarify when certain fees are not payable, and require certain passengers and crew between any foreign port and New Zealand to apply for and be granted a visa before arrival.

Special Direction - Grant of RSE Limited Visas to a Class of Onshore Persons Who Were Previously Granted Limited Visas as Stranded RSE Workers to Manage the Effects and Deal with Consequences of Measures Taken to Contain or Mitigate the Outbreak or Effects of COVID-19

  • Grants a new RSE visa to stranded RSE workers in New Zealand who have not yet been able to return home and who enter into an acceptable employment agreement with an approved RSE employer.

Special Direction - Grant Supplementary Seasonal Employment Temporary Visas to a Class of Onshore Persons Whose Visas are Expiring to Manage Effects and Deal With Consequences of Measures Taken to Contain or Mitigate the Covid-19 Outbreak or its Effects

  • Grants temporary Supplementary Seasonal Employment (SSE) visas with an expiry date of 30 June 2021 to persons who are in New Zealand and holding Working Holiday Scheme or Working Holidaymaker Extension visas.
